Dispute Solutions

When an issue escalates to formal dispute, the Expert Advisory Team can assist parties in preparing or defending the case. Where you have a lack of resources, our team can support and supplement your team to help with identifying the significant issues, to help shape and present them in a manner suitable for the appropriate dispute resolution approach.

We can support and complement the services of legal teams, by providing appropriate levels of expertise at the right time to act as the technical interface between the legal team and construction personnel closely involved with the dispute.

Expert and Litigation Support

Our Expert Advisory Team is able to provide qualified and experienced teams focused on assisting through expert services and litigation support. Our Team can provide technical experts with extensive experience in the construction field, to help a party with preliminary expert support in the preparation of their dispute or with support through litigation processes. We provide assistance with:

Team Workshops: Fact finding and strategy workshops to help a party understand the nature of the dispute and to help develop strategies for the framing of claims. Help with the provision of neutral guidance on matters to assist the party in developing realistic objectives on the merits of particular claims.
Risk Review: Assist a party to develop realistic reviews of risk, both in terms of the merits of the other party’s counterclaims. In particular, help a party to identify and determine level at which to offer settlements.
Litigation Support: Provide a technical interface between the party and their legal team. In particular, our Expert Advisory Team can support a party and its legal team present their technical submissions in clear and understandable terms.

Adjudicator, Arbitrator and Expert Determiner

Drawing on the experience of our expert practitioners, the Expert Advisory Team can provide independent Neutrals to provide reasoned decisions. With Expert Determination, the Expert Advisory Team can guide the parties, allowing them to make representations and document submissions, ultimately on a route to securing a non-binding, cost effective and impartial settlement of their quantum, delay and contract matters.
